Open
An Open tribute may be accessible to anyone who has the applicable link or otherwise obtains access to the tribute.
Private
A Private tribute requires approval or authorization before someone can access it.
Family Only
A Family Only tribute is intended to restrict access to invited participants.

6. Your Memorial Content
You and your contributors retain ownership of the photographs, videos, messages, stories, and other content submitted to TributeWell. TributeWell does not sell your memorial content.
We process and store memorial content solely for purposes reasonably necessary to provide and operate the Service, including hosting your tribute, displaying content to authorized viewers, allowing authorized contributors to participate, creating backups, providing downloads and exports, maintaining security, troubleshooting, preventing abuse, and meeting legal obligations.
TributeWell does not claim ownership of your memorial content. You are responsible for ensuring that you have the rights and permissions necessary to upload or share content through TributeWell.
7. How We Share Information
We do not sell your personal information or your memorial content. We may share information in the following limited circumstances.
Service Providers
We use trusted third-party service providers that help us operate TributeWell. Depending on the services we use, these providers may assist with website and cloud hosting, data storage, payment processing, email delivery, security and fraud prevention, analytics, customer support, infrastructure and technical services, and other functions necessary to operate TributeWell. These providers may process information on our behalf and are expected to handle information in accordance with applicable contractual and legal requirements.
Legal Requirements
We may disclose information when reasonably necessary to comply with a subpoena, court order, legal process, or applicable law; respond to a lawful government request; protect the rights, property, or safety of TributeWell, our users, or others; investigate fraud, abuse, or security issues; or enforce our Terms of Service.
Business Transfers
If TributeWell or BillCore, LLC is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, information associated with the Service may be transferred as part of that transaction. Any such transfer will remain subject to applicable privacy obligations.
8. Referral Partners and Sponsors
TributeWell may work with funeral homes, cremation providers, nonprofits, organizations, media companies, affiliates, and other partners. When you arrive at TributeWell through a referral link or other partner arrangement, we may use cookies or similar technologies to attribute your visit or purchase to that partner.
Partner organizations may receive limited information necessary to administer referral relationships, such as referral activity, registrations, purchases, and applicable commissions. We do not provide partners with unrestricted access to your TributeWell account or memorial content unless you expressly authorize such access or it is necessary to provide a service you have requested.
Sponsored content or promotional relationships may be identified as such on third-party websites.
9. Cookies and Similar Technologies
TributeWell may use cookies and similar technologies to operate and improve the Service. These technologies may be used for authentication, session management, preferences, security, analytics, performance measurement, and referral attribution.
For example, when you visit TributeWell through an authorized referral link, a referral cookie may be used to determine whether a subsequent purchase should be attributed to that referral partner. You can control cookies through your browser settings. Some features may not function properly if certain cookies are disabled.
10. Data Retention
We retain information for as long as reasonably necessary to provide the Service, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and protect our legitimate business interests.
Free trials
During a free trial, your tribute may remain available for the period specified when the trial is created and may remain available for collecting memories during that period.
Paid plans
With a paid plan, your tribute remains available for ongoing use for the applicable period described by your plan. A Lifetime Plan provides ongoing access for the lifetime of the TributeWell service, subject to the TributeWell Terms of Service.
You may download eligible content or request deletion of your tribute, subject to the applicable terms and technical limitations.
11. Deletion and Data Export
TributeWell provides tools that allow eligible users to download certain content associated with their tributes. Depending on the features available, this may include photographs, videos, messages, stories, guestbook entries, and other collected content.
You may request deletion of your account or tribute by contacting us at info@tributewell.com or through available account controls. Before requesting deletion, we strongly recommend downloading and preserving any content you wish to keep. Once content has been permanently deleted, it may not be recoverable.
Content may remain temporarily in backup systems as part of ordinary backup, security, disaster-recovery, or business-continuity processes before being overwritten or securely deleted. We may retain certain information when reasonably necessary to comply with law, resolve disputes, prevent fraud or abuse, enforce our agreements, or protect the security and integrity of the Service.
12. Business Continuity and Service Discontinuation
TributeWell is being developed and operated as a long-term service. We maintain reasonable business-continuity practices intended to support continued operation of the Service and the protection and recovery of customer information.
No online service or business can guarantee operation indefinitely under every possible circumstance. If TributeWell were ever to permanently discontinue the Service, we intend to make reasonable efforts to:
- Provide advance notice to affected users where reasonably practical;
- Provide a reasonable opportunity to access and download available content; and
- Provide information concerning available data-export or preservation options.
These efforts may be limited by circumstances beyond our reasonable control, including catastrophic infrastructure failures, governmental action, insolvency, force majeure events, or other circumstances that make continued operation impracticable. Additional provisions concerning Lifetime Plans and service discontinuation are contained in our Terms of Service.
13. Security
We use reasonable technical, administrative, and organizational safeguards designed to protect personal information and memorial content. These measures may include encrypted connections, secure cloud infrastructure, access controls, authentication controls, monitoring and security measures, backups, and other appropriate technical and operational safeguards.
Access to personal information is limited to circumstances where access is reasonably necessary to operate, maintain, secure, or support the Service or comply with legal obligations. However, no method of transmitting or storing information electronically is completely secure. We therefore cannot guarantee that information will never be accessed, altered, disclosed, lost, or destroyed as a result of circumstances beyond our reasonable control.
14. Children's Privacy
TributeWell is intended for use by adults, and account creation and tribute ownership require users to be at least 18 years old. We do not knowingly intend to collect personal information directly from children under 13 without the permissions or procedures required by applicable law.
TributeWell allows invited guests to contribute certain content to a tribute, and guests may be able to contribute without creating an account. Because tribute content may include photographs, videos, names, and other information about children, we encourage parents and guardians to supervise children's participation.
If we become aware that we have collected personal information directly from a child under 13 in circumstances requiring parental consent, we will take reasonable steps to address the situation in accordance with applicable law. Parents or legal guardians who believe a child has provided personal information to TributeWell may contact us at info@tributewell.com. We may request information reasonably necessary to verify the identity and authority of the person making such a request.
15. Your Privacy Rights and Choices
Depending on where you live and applicable law, you may have certain rights regarding your personal information. These may include the right to:
- Request access to personal information we maintain about you;
- Request correction of inaccurate information;
- Request deletion of personal information;
- Request a copy or export of certain information;
- Object to or restrict certain processing;
- Withdraw consent where processing is based on consent; and
- Exercise other rights provided by applicable law.
You may submit a privacy request by contacting info@tributewell.com. We may need to verify your identity before completing certain requests. We will respond to valid requests within the time required by applicable law. Certain information may be exempt from deletion or other requests where retention is required or permitted by law.
16. California and Other State Privacy Rights
Certain U.S. states provide residents with additional privacy rights. Depending on whether applicable state privacy laws apply to TributeWell and depending on your circumstances, residents may have rights concerning access to personal information, correction, deletion, data portability, restrictions on certain processing, opting out of certain forms of sale or sharing, and other rights established by applicable state law.
TributeWell does not sell personal information. We will not discriminate against you for exercising privacy rights available to you under applicable law. Where a state law requires additional disclosures, procedures, or rights, those requirements will apply to eligible residents. Because state privacy laws and their applicability can change, please contact info@tributewell.com with questions regarding a specific privacy request.
17. International Visitors
TributeWell is operated from the United States and may be used by families and individuals in other countries. If you use TributeWell from outside the United States, your information may be processed, stored, or accessed in the United States and other countries where TributeWell or its service providers operate.
Those countries may have data-protection laws that differ from the laws in your country of residence. By using the Service, you understand that your information may be processed in the United States and other jurisdictions as reasonably necessary to provide the Service. Where applicable law provides additional rights regarding international data transfers or processing, TributeWell will comply with those requirements.
18. Third-Party Websites and Services
TributeWell may contain links to websites, services, or resources operated by third parties. TributeWell is not responsible for the privacy practices of third-party websites or services. We encourage you to review the privacy policies of third-party services before providing them with personal information.
19. Business Partners and Funeral Homes
TributeWell may provide services through or in cooperation with funeral homes, cremation providers, nonprofits, organizations, media companies, and other partners. Unless expressly stated otherwise, those organizations do not automatically receive access to the personal information or memorial content stored in your TributeWell account. Any access provided to a partner will be subject to the applicable service arrangement, your privacy settings, and applicable law.
20. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our services, business practices, technology, or applicable law. When we make changes, we will update the "Last updated" date at the top of this policy. If we make material changes, we may provide additional notice through the Service, by email, or by other reasonable means where appropriate.
Your continued use of TributeWell after an updated Privacy Policy becomes effective constitutes acknowledgment of the updated policy to the extent permitted by law.
